Terms of service

These terms apply to the purchase and sale of products through noviembreskin.com. "We", "us" and "noviembre" mean the operator of this site. We may change these terms at any time; the current version always lives on this page and continuing to use the site after a change means you accept it.

Read them alongside our Privacy policy, Shipping policy, Returns & refunds, Subscriptions and Website terms of use, all of which form part of this agreement.

Orders

Your order is an offer to buy. It becomes a contract only when we send you an order confirmation email. We may decline or limit any order, and we may cancel one after it is placed — if we do, and you have already paid, we refund you in full.

Payment must be received before we accept an order. All items are subject to availability. If something you ordered is unavailable we will tell you promptly and either offer a substitute or refund it.

Personal use only

We sell for personal use. You may not resell our products without our written consent. If we believe an order is placed for resale, or is fraudulent, we may cancel it, close your account, and take any remedy the law allows.

Subscriptions

Both subscription plans renew automatically until cancelled. The cadence, the amount and how to cancel are set out in full in Subscriptions, which forms part of these terms. By placing a subscription order you agree to the auto-renewal.

Keep your billing details current. If your card is replaced, expires or is cancelled, update it or tell us.

Prices and payment

Prices, availability and terms can change. We try hard to keep the site accurate, but we are not bound by pricing or typographical errors and may cancel orders that result from them; if your card was already charged, we refund it in full.

Posted prices exclude tax and shipping, both of which are itemised at checkout. We collect sales tax where we are required to. By paying, you confirm the payment method is yours and authorised.

Shipping, title and risk

See our Shipping policy. Delivery dates are estimates and are not guaranteed. Title and risk pass to you when the carrier takes the parcel — but read the lost and damaged section of that policy, because in practice we make it right.

Returns

See Returns & refunds. Inside your guarantee window we refund you and you keep the product.

About the product

We describe revél as accurately as we can and photograph the actual product. Even so, we do not warrant that every description is complete or error-free, or that packaging will always match the photographs exactly — formulas and packaging are updated over time. If what arrives is not what was described, your remedy is a refund under the returns policy.

Skin, sensitivity and medical advice

revél is a cosmetic product. Nothing on this site is medical advice, and nothing here is intended to diagnose, treat, cure or prevent any condition. We are not your dermatologist.

Patch test before first use. Stop using it if you get persistent stinging, burning or a rash. Talk to a doctor or dermatologist before using it if you are pregnant or nursing, are using prescription retinoids or acne medication, have a diagnosed skin condition, or have had a reaction to acids before. Keep out of reach of children. For external use only. Avoid the eye area.

Intellectual property

The noviembre and revél names, the logo, the site and everything on it — text, photography, video, layout and code — belong to us or our licensors and are protected by copyright and trademark law. You may not use them without our written consent. Other marks on the site belong to their owners.

We respect other people's copyright. If you believe something here infringes yours, email hello@imnoviembre.com with a description of the work, where it appears on our site, your contact details, a statement that you believe in good faith the use is not authorised, and a statement made under penalty of perjury that your notice is accurate and that you are the owner or authorised to act for them.

Disclaimer of warranties

Except where the law does not allow it, products and the site are provided "as is" and "as available". We disclaim implied warranties including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free.

Limits on liability

To the extent the law allows, we are not liable for indirect, special, incidental or consequential damages — lost profits, lost data, or the cost of substitutes — arising from the site or the products. Our total liability for any claim will not exceed what you paid us in the six months before it arose.

Nothing here excludes liability that cannot legally be excluded, including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow these limits, in which case they apply only as far as that jurisdiction permits.

Indemnity

You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these terms.

Events outside our control

Neither of us is liable for failing to perform because of something outside our reasonable control — natural disaster, fire, war, civil unrest, government action, epidemic, strike, carrier failure, power or telecommunications outage, or supply shortage. We will tell you promptly and do what we reasonably can to limit the effect. If it lasts more than 30 days, either of us may end the affected order.

Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in Florida, and you agree to their jurisdiction.

General

You may not assign your rights under these terms without our consent. If we do not enforce a provision, that is not a waiver of it. If any provision is held unenforceable, the rest stays in force. These terms, together with the policies they reference and your order confirmation, are the whole agreement between us.
